This Acceptable Use Policy (this “Policy”) describes prohibited uses of the web services offered by Accredify Pte. Ltd. and its related corporations and affiliates (also referred to as “Accredify”, “us”, “we”, or “our”) (the “Services”) and the website located at https://accredify.io/ (the “Accredify Site”). The examples described in this Policy are not exhaustive. We may modify this Policy at any time by posting a revised version on the Accredify Site. By using the Services or accessing the Accredify Site, you agree to the latest version of this Policy. If you violate the Policy or authorise or help others to do so, we may suspend or terminate your use of the Services.
1. No Illegal, Harmful, Wrongful, or Offensive Use or Content.
You may not use, or encourage, promote, facilitate or instruct others to use, the Services or Accredify Site for any illegal, harmful, wrongful, fraudulent, infringing or offensive use, or to transmit, store, display, distribute or otherwise make available content that is illegal, harmful, fraudulent, infringing or offensive. Prohibited activities or content include:
- Illegal, Harmful or Fraudulent Activities. Any activities that are or encourages illegal, tortious or inappropriate conduct, that violate the rights of others, or that may be harmful to others, our operations or reputation. Such activities include disseminating, promoting or facilitating child pornography, offering or disseminating fraudulent goods, services, schemes, or promotions, make-money-fast schemes, ponzi and pyramid schemes, phishing, pharming or any violation of any law including without limitation data, privacy, and export control laws.
- Infringing Content. Content that infringes or misappropriates the intellectual property, proprietary or other rights of Accredify or third parties including any copyright, trademark, patent, trade secret, moral rights, privacy rights of publicity, or any other intellectual property right or proprietary or contractual right
- Offensive Content. Content that is deceptive, fraudulent, illegal, defamatory, obscene, libellous, threatening, harmful to minors, pornographic, indecent, harassing or bullying, hateful, abusive, invasive of privacy, or otherwise objectionable. Such offensive content include content that constitutes child pornography, relates to bestiality, or depicts non-consensual sex acts and content that attacks others based on their race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, or medical condition
- Others Inappropriate Content. Content that contains viruses, bots, worms, scripting exploits, or other similar materials, is intended to be inflammatory or could otherwise cause damage to Accredify or any third party.
- Harmful Content. Content or other computer technology that may damage, interfere with, surreptitiously intercept, or expropriate any system, program, or data, including viruses, Trojan horses, worms, time bombs, or cancelbots.
- Misrepresentation. Misrepresentation of yourself, or disguising the origin of any content (including by “spoofing”, “phishing”, manipulating headers or other identifiers, impersonating anyone else, or falsely implying any sponsorship or association with Accredify or any third party).
- Violation of Privacy. Using the Services to violate the privacy of others, including publishing or posting other people’s private and confidential information without their express permission, or collecting or gathering other people’s personal information (including account names or information) from our Services.
- Harassment and Threats. Using our Services to stalk, harass, or post direct, specific threats of violence against others.
- Scraping. Accessing or searching any part of the Services by any means other than our publicly supported interfaces (for example, “scraping”).
- Unauthorised Use of Meta Tags and Marks. Using meta tags or any other “hidden text” including Accredify’s or our suppliers’ product names or trademarks.
2. No Security Violations.
You may not use the Services to violate the security or integrity of any network, computer or communications system, software application, or network or computing device (each, a “System”). Prohibited activities include:
- Unauthorised Access. Accessing or using any System without permission, including attempting to probe, scan, or test the vulnerability of a System or to breach any security or authentication measures used by a System.
- Interception. Monitoring of data or traffic on a System without permission.
- Deciphering of Transmission. Deciphering any transmissions to or from the servers running the services.
- Falsification of Origin. Forging TCP-IP packet headers, e-mail headers, or any part of a message describing its origin or route. The legitimate use of aliases and anonymous remailers is not prohibited by this provision.
- Tampering of Services. Tampering with, reverse-engineering, or hacking our Services, circumventing any security or authentication measures, or attempting to gain unauthorised access to the services, related systems, networks, or data.
- Modifying of Services. Modifying, disabling, or compromising the integrity or performance of the services or related systems, network or data.
- Overwhelming of Infrastructure. Overwhelming or attempting to overwhelm our infrastructure by imposing an unreasonably large load on our systems that consume extraordinary resources (CPUs, memory, disk space, bandwidth, etc.), such as:
- Using “robots,” “spiders,” “offline readers,” or other automated systems to send more request messages to our servers than a human could reasonably send in the same period of time by using a normal browser
- Going far beyond the use parameters for any given service as described in its corresponding documentation
- Consuming an unreasonable amount of storage for music, videos, pornography, etc., in a way that is unrelated to the purposes for which the Services were designed
3. No Network Abuse.
You may not make network connections to any users, hosts, or networks unless you have permission to communicate with them. Prohibited activities include:
- Monitoring or Crawling. Monitoring or crawling of a System that impairs or disrupts the System being monitored or crawled.
- Denial of Service (DoS). Inundating a target with communications requests so the target either cannot respond to legitimate traffic or responds so slowly that it becomes ineffective.
- Intentional Interference. Interfering with the proper functioning of any System, including any deliberate attempt to overload a system by mail bombing, news bombing, broadcast attacks, or flooding techniques.
- Operation of Certain Network Services. Operating network services like open proxies, open mail relays, or open recursive domain name servers.
- Avoiding System Restrictions. Using manual or electronic means to avoid any use limitations placed on a System, such as access and storage restrictions.
4. Inappropriate communications.
- You will not distribute, publish, send, or facilitate the sending of unsolicited mass e-mail or other messages, promotions, advertising, or solicitations (like “spam”), including commercial advertising and informational announcements. You will not alter or obscure mail headers or assume a sender’s identity without the sender’s explicit permission. You will not collect replies to messages sent from another internet service provider if those messages violate this Policy or the acceptable use policy of that provider. You will not disparage Accredify or our partners, vendors, or affiliates.
5. Sanctions.
“Control” means the power to direct the management or policies of any person, including, without limitation, through the ownership of over fifty percent (50%) of the voting power of such person or through the power to appoint more than half of the board of directors or similar governing body of such entity or through contractual arrangements or otherwise.
“Sanctions” means all economic or financial sanctions laws, measures or embargoes administered or enforced by the United States (including the United States Department of the Treasury or the United States Department of State), the European Union, the United Nations, the United Kingdom and any other relevant sanctions imposed by any relevant governmental authority.
“Sanctioned Person” means (a) any person that at such time is designated on the list of “Specially Designated Nationals and Blocked Persons” administered by the U.S. Treasury Department’s Office of Foreign Asset Control, or on any list of any economic or financial sanctions administered by the U.S. State Department, the United Nations, the European Union or any member state thereof, the United Kingdom, or any other national economic sanctions authority, (b) any government, national, or resident of, or legal entity located in or organized under, a country or territory which is the subject of country-wide or territory-wide Sanctions, including Cuba, North Korea, Syria, Iran, Venezuela, the Crimea region of Ukraine, Russia and Belarus, (c) any person who is majority-owned or controlled by any of the foregoing, or (d) any person with whom business transactions, including exports and re-exports, would violate Sanctions.
You have not conducted, is not conducting, or agreed to conduct any business, or entered into or agreed to enter into, any transaction with or for the benefit of a Sanctioned Person, and no part of the proceeds or fees paid or payable arising out of or in connection to your engagement with us will be used (directly or indirectly) for any payments to (i) any Sanctioned Person, or (ii) otherwise in violation of Sanctions, and you shall not conduct nor agree to conduct any of the forgoing. Neither you nor any of your affiliates, directors, officers, employees and any other persons acting on behalf of any of them are owned or Controlled by a Sanctioned Person, or any other person that is targeted by or the subject of any Sanctions, and you nor any of your affiliates, directors, officers, employees and any other persons acting on behalf of any of them shall not be owned or Controlled by such persons.
6. Our Monitoring and Enforcement.
We reserve the right, but do not assume the obligation, to investigate any violation of this Policy or misuse of the Services or Accredify Site. We may:
- investigate violations of this Policy or misuse of the Services or Accredify Site; or
- remove, disable access to, or modify any content or resource that violates this Policy or any other agreement we have with you for use of the Services or the Accredify Site.
We may report any activity that we suspect violates any law or regulation to appropriate law enforcement officials, regulators, or other appropriate third parties. Our reporting may include disclosing appropriate customer information. We also may cooperate with appropriate law enforcement agencies, regulators, or other appropriate third parties to help with the investigation and prosecution of illegal conduct by providing network and systems information related to alleged violations of this Policy.
7. Reporting of Violations of this Policy.
If you become aware of any violation of this Policy, you will immediately notify us and provide us with assistance, as requested, to stop or remedy the violation.
